Der Fokus liegt auf dem schweizerischen Kartellrecht. Aufgeschlüsselt werden Aspekte, welche zu einer Erfassung der UVP als vertikale Wettbewerbsabrede i.S.v. Art. 4 Abs. 1 KG führen können. Nebst der Befolgung sind dabei weitere Umstände, wie bspw. eine allfällige Druckausübung oder Anreizgewährung, zu berücksichtigen. Vertieft wird die materiell-rechtliche Beurteilung der UVP nach Art. 5 KG. Eingegangen wird auf die Bedeutung und die Umstände einer Erfassung durch Art. 5 Abs. 4 KG sowie auf die Widerlegung der gesetzlichen Vermutung im Fall der UVP. Ein weiterer Fokus liegt auf der Ermittlung der Erheblichkeit der Wettbewerbsbeeinträchtigung im Fall der UVP (Art. 5 Abs. 1 KG). Unter Berücksichtigung der ökonomischen Betrachtung der UVP wird deren Rechtfertigung i.S.v. Art. 5 Abs. 2 KG untersucht sowie auf die in Frage kommenden Effizienzgründe eingegangen. Schliesslich widmet sich die Arbeit den Fragen der Beweislast und des Beweismasses sowie der prozessualen Beurteilung einer Einstellung der UVP. | |
| 520 | 3 | |a The thesis provides an examination of the Manufacturer Suggested Retail Price [MSRP] from a competition law perspective taking into account economic findings. The focus is on Swiss competition law. Aspects which lead to the recognition of a MSRP in terms of Art. 4 Para. 1 CartA are outlined. In addition to retailer's adherence to MSRP further circumstances, such as exertion of pressure or incentives, have to be taken into consideration. An indepth analysis of Art. 5 CartA is carried out. The substantive evaluation of MSRP includes the consequences and conditions of a recognition by Art. 5 Para. 4 CartA as well as the rebuttal of the legal presumption. The significance of a MSRP based suppression of effective competition is examined (Art. 5 Para. 1 CartA). With regard to the economic findings, the justification based on grounds of economic efficiencies according to Art. 5 Para. 2 CartA is analyzed in the specific case of a MSRP. Finally, the burden of proof as well as the standard of evidence are explained. Moreover, procedural consequences of a dismissal of a MSRP are pointed out. | |
